Basic Cloud Storage | Terms of Use

These Terms of Use ("Terms") govern your use of the Basic Cloud Storage online file storage platform (“Service”) operated by Hive 9 Systems Pty Ltd trading as Basic Cloud Storage ("we", "us", "our"). By registering for or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement under Australian law to use the Service.

2. Account Registration

To access our Service, you must register and maintain an active user account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3. Use of Service

You may use the Service solely for lawful purposes and in accordance with these Terms. You are responsible for all content and data uploaded, stored, or shared via the Service.

You agree not to:

Use the Service for any unlawful or prohibited purpose;

Use automated systems to send more requests to our servers than a human could reasonably produce in the same period.

4. Data Ownership and Responsibility

You retain full ownership of any data you upload to the Service. However, you use the Service and store data at your own risk. We take reasonable steps to protect your data, but we do not guarantee against data loss, unauthorised access, or corruption. It is your responsibility to maintain appropriate backups of your data.

5. Law Enforcement and Legal Requests

We comply with all applicable Australian laws. This includes responding to lawful requests from law enforcement and government agencies. By using the Service, you consent to us disclosing your data if required by subpoena, court order, or applicable legislation.

6. Data Storage Location

Data may be stored on servers located in Australia or overseas. We use reputable infrastructure providers who meet relevant data security standards, but we do not guarantee the geographic location of data at any given time.

7. Termination

We reserve the right to suspend or terminate your access to the Service at our discretion, particularly in the event of any breach of these Terms.

You may close your account at any time. Upon termination, your stored data may be permanently deleted. You are solely responsible for exporting or backing up your data prior to termination.

8. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Hive 9 Systems Pty Ltd trading as Basic Cloud Storage shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data or profits, arising out of your use of or inability to use the Service.

10. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Western Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts of Western Australia in connection with any dispute.
